Court Denies Defendants’ Motion to Dismiss under Alice/Section 101

MPS v. PRRS and LAZ

A big win against PRRS today.  In the matter of Municipal Parking Services, Inc. v. Parking Revenue Recovery Services, Inc. et. al. U.S. District Court Judge Alan D. Albright denied PRRS’s motion to dismiss for lack of patentable subject matter (PRRS’s Alice motion).  PRRS had alleged that the asserted MPS claims were invalid as being directed only to an abstract idea which, if true, would not be eligible subject matter for patenting under 35 USC §101.  

 

The speed by which the Court reached this decision is notable.  MPS had not even filed its responsive brief.  Even before seeing MPS’s response, the Judge reviewed and rejected PRRS’s motion.  While the Court indicated that PRRS may re-raise the issue of patentability under section 101 after the close of discovery during the pre-trial summary judgment phase of the litigation, this decisive and early win on this issue gives MPS confidence that any attempt by PRRS to re-raise this issue will also be denied by Judge Albright.
